1. Software License & Zero-Custody Architecture
SmallFast is browser-executed software, not a cloud storage locker or cloud rendering farm. All files stay on your hardware; SmallFast never receives or holds custody of your content.
Tensix Technologies ("SmallFast", "we", "us", or "our") grants you a personal, worldwide, non-exclusive, non-transferable license to access and use the SmallFast web application in accordance with these Terms.
SmallFast operates as an in-browser utility utilizing WebAssembly (WASM), WebCodecs, and HTML5 Canvas. Because media processing occurs locally within your web browser sandbox, SmallFast does not host, replicate, transmit, possess, or store your original or converted media files.
2. Acceptable Use & Prohibited Content
You agree not to select, load into browser memory, compress, convert, or export any of the following categories of prohibited content:
Strictly prohibited under all circumstances without exception. Zero tolerance.
Intimate, private, or sexual imagery created or disseminated without consent.
Material promoting violent extremism, terrorist incitement, or criminal operations.
Media that violates third-party intellectual property, trademarks, or proprietary trade secrets.
Because all file selection and computation takes place directly on your own hardware without transmission to SmallFast servers, you retain sole, exclusive, and unindemnified legal liability for all content processed through the application. SmallFast disclaims all legal liability for user-selected content.
3. Intellectual Property & Content Ownership
You retain 100% full, unencumbered ownership, copyright, and title over all photographs, videos, audio, and media files you process using SmallFast.
SmallFast asserts zero intellectual property claims, licenses, or rights over your media. We do not use your media to train machine learning models, build datasets, or produce derivative works.
All SmallFast branding, visual designs, logos, software code, and interface assets remain the exclusive intellectual property of Tensix Technologies.
4. Free Tier & Lifetime Pro Purchase Terms
Payment Processing & Digital Fulfillment
Lifetime Pro purchases are processed securely through Ziina. When payment is verified, your Clerk user account is immediately upgraded to Pro status.
Because SmallFast Lifetime Pro is a digital software entitlement that is unlocked and fulfilled immediately upon payment confirmation, purchases are non-refundable once unlocked, except where mandatory consumer refund rights apply under applicable local legislation. If you experience technical defects preventing software activation, please contact support.
5. Hardware Performance & Local Execution
Because SmallFast uses in-browser WebAssembly to perform computationally intensive tasks (such as video transcoding, H.264/H.265 compression, and high-resolution image quantization), processing performance directly correlates with your personal device's available hardware specifications (CPU speed, memory allocation, and thermal throttling).
SmallFast is not responsible for device slowdowns, temporary browser tab freezing, or memory eviction caused by processing extremely large video files beyond your system's physical capabilities.
6. Disclaimer of Warranties & Limitation of Liability
AS-IS Software Provision
SmallFast is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In no event shall Tensix Technologies, its founders, directors, employees, or contractors be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data corruption, or hardware malfunction arising from your use of the application.
You agree to defend, indemnify, and hold harmless Tensix Technologies from any claims, damages, liabilities, and expenses arising from your violation of these Terms or applicable laws.
7. Modifications & Contact Information
We reserve the right to amend or update these Terms periodically. Any modifications will be posted to this page with an updated "Last updated" timestamp. Continued use of SmallFast constitutes acceptance of the revised Terms.
